Terms & Conditions

These terms apply to every order placed on orbavie.shop. Please read them before you order. If you are a consumer, nothing in these terms limits the rights you have under the consumer laws of your country, including the Australian Consumer Law.

Who can order
We sell to consumers aged 18 or over, for delivery to the countries listed on our Shipping page. We do not sell for resale.
Our products
We describe each piece as accurately as we can: cut, ring size and position, colour, surface and available sizes. Colours can look slightly different on different screens. Photos may show a bikini top with a bottom, or a cover-up over a bikini: the other pieces are sold separately unless the product page says otherwise. The fibre composition is on the sewn-in care label; ask us before you order if you need it.
Prices and currency
Prices are shown in the currency of your delivery country (USD, EUR, GBP, DKK, SEK, NOK, CHF or AUD), with the currency code next to the amount. You pay in that currency. Prices are final prices for the goods; delivery costs are shown separately in your bag and at checkout before you place your order. Prices for delivery within Australia include GST. For deliveries that cross a customs border, import charges may apply as explained on our Shipping page. We do not run promotions or discount codes.
How a contract is made
- You choose your pieces and sizes and add them to your bag.
- At checkout you enter your details, choose a payment method and review your order, including all costs. You can correct any input errors before you submit.
- By clicking “Place order and pay” you make a binding offer to buy the goods in your bag.
- We email you an order confirmation. The contract is made when we send that confirmation.
The contract language is English; translated pages are provided for convenience. We store the contract text, and the order confirmation email contains the order details and a link to these terms. You can also see past orders in your account if you have one.
Payment
We accept the payment methods shown at checkout. Your payment is taken when you place your order. Payments are processed over an encrypted connection by our payment providers, which are certified to PCI DSS; we never see or store your full card number. Your card statement will show ORBAVIE.
Delivery and risk
We deliver to the address you give us, within the estimated times on our Shipping page. If you are a consumer, risk of loss or damage passes to you when the goods are delivered to you or to a person you nominate. If we cannot deliver within 30 days of your order, we will tell you, and you can cancel and receive a full refund.
Returns and right of withdrawal
You can return unworn items within 30 days of delivery, subject to our swimwear hygiene conditions. Consumers in the EU, the UK and Norway also have a statutory 14-day right of withdrawal. Consumer guarantees and warranty
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
If you live in the EU or the UK, you also have the statutory rights of your country for goods that are not in conformity with the contract. Normal wear of the ring plating and fabric through use, chlorine, salt or sunscreen is not a defect; see our Ring care guide.
Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or under the Australian Consumer Law and other mandatory consumer laws. We are not liable for business losses, as we sell to consumers only.
Your account
If you create an account, keep your password confidential. You can close your account at any time by emailing us.
Intellectual property
All content on this site — designs, photographs, text and the ORBAVIE name and ring mark — belongs to us or our licensors and may not be copied for commercial use without our permission.
Complaints and disputes
If something goes wrong, please contact us first at support@orbavie.shop — we will reply within two business days and try to put it right.
- Australia: you can contact the fair trading office in your state or territory, such as the Queensland Office of Fair Trading.
- EU: the European Commission’s online dispute resolution platform closed on 20 July 2025. For help with a cross-border complaint, you can contact the European Consumer Centre in your country (ECC-Net).
- Germany: we are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
- Denmark: you can submit a complaint to Nævnenes Hus (Center for Klageløsning), Toldboden 2, 8800 Viborg, via naevneneshus.dk.
Governing law
These terms are governed by the laws of Queensland, Australia. If you are a consumer living in another country, you also keep the protection of the mandatory consumer laws of your country of residence, and you can bring proceedings in the courts of your country.
Changes to these terms
We may update these terms. The version that applies to your order is the one shown on this site when you place it.
